These terms govern your use of the Josh Fuels platform operated by Jetway Oil and Fuel Services Home Pvt. Ltd.
Jetway Oil and Fuel Services Home Pvt. Ltd. (JOSH / Josh Fuels) provides a technology platform that enables authorised petroleum product dealers to supply diesel and customers to purchase diesel at their doorstep efficiently. By accessing or using the platform, you agree to be bound by these Terms and Conditions.
These terms are subject to change without notice. Continued use of the platform constitutes acceptance of any updates. Users confirm they are legally competent to be bound by these terms under Indian Law.
Users must provide correct, complete, accurate, and up-to-date information during registration. End customers and dealers must submit identity proof of principal officers along with entity registration proof. Failure to do so constitutes unauthorised access and may result in service restriction or account termination at Josh Fuels' sole discretion.
Users must notify Josh Fuels immediately of any security breach or unauthorised account use. Josh Fuels is not liable for losses arising from unauthorised account use; users remain liable for losses Josh Fuels incurs from such misuse.
The platform facilitates diesel delivery and supply at specified locations on scheduled timings. Access is via mobile number verification using One-Time Passwords (OTP). By using the services, users consent to SMS and other communications related to orders and account activity.
Josh Fuels does not guarantee dealer availability in all locations. Upon order placement, the platform links customers with the nearest available dealer. Upon confirmation by both parties, the dealer provides an estimated delivery time. Josh Fuels may estimate total transaction costs, subject to final dealer invoices.
Orders typically deliver within 3–8 hours during working hours (sunrise to sunset). Both dealers and end customers can access each other's locations through the platform during the active delivery window. Delivery schedules are subject to standard operating procedure adherence and prevailing pricing.
Product prices are government-regulated and change daily. Customers pay the price prevailing at the time of delivery, regardless of when the order was placed. Product costs and delivery charges are payable directly to the dealer, who issues an invoice upon payment receipt. Josh Fuels may separately charge service fees with prior consent.
Customers may request quality testing from dealers before accepting delivery. Quality testing uses density testing performed by the dealer upon request. Quantity verification uses 5-litre calibrated jars. End customers bear responsibility for verifying product quality and quantity. Josh Fuels bears no responsibility for quality or quantity disputes. All claims must be raised at the time of delivery — claims raised after acceptance will not be entertained.
End customers warrant that they will:
Dealers warrant that they will comply with applicable supply laws, not supply substandard materials, maintain information transparency, adhere to absolute safety standards, and not provide misleading information to customers.
All dealers and end customers must adhere to Petroleum and Explosive Safety Organisation (PESO) standard operating procedures for safe, secure product delivery.
Josh Fuels grants a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence for lawful personal use of the platform. Users may not:
All platform content — including text, graphics, logos, icons, images, audio clips, and software — is the exclusive property of Josh Fuels or its licensors, protected under Indian and international intellectual property laws. Unauthorised reproduction, modification, distribution, or display is strictly prohibited. Josh Fuels trademarks may not be used without prior written authorisation.
Contracts are entered between dealers and end customers on a principal-to-principal basis. Josh Fuels acts as neither agent nor representative for either party. Neither party has authority to assume obligations on behalf of Josh Fuels or bind Josh Fuels in any manner.
Dealers are solely responsible for ensuring comprehensive coverage — including for theft, fire, natural calamity, unrest, and workmen's compensation — while products are transported, supplied, and transferred to end customers. This is at the dealer's own cost and does not extend to events caused by end-customer negligence.
Upon breaching any of these terms or applicable law, the user's relationship with Josh Fuels automatically terminates. Josh Fuels may also terminate any account at its sole discretion without reason or notice.
Josh Fuels reserves the right to interrupt, restrict, modify, or discontinue the platform — temporarily or permanently — without cause or notice. Josh Fuels bears no liability for any modifications, suspensions, or discontinuances.
Third-party services accessible through the platform — including dealer services and payment processing — are governed by their own terms and conditions. Josh Fuels bears no responsibility for third-party terms, content, or actions. Links to external platforms are provided for convenience only and do not constitute endorsement.
To the maximum extent permitted by applicable law, all services are provided "as-is" and "as available" without any express warranties, guarantees, or conditions. Josh Fuels makes no warranties regarding accuracy, timeliness, performance, completeness, or suitability of information on the platform. Use of the platform is entirely at the user's own risk.
To the maximum extent permitted by applicable law, Josh Fuels, its directors, employees, representatives, and agents are not liable for any personal injury, special, incidental, indirect, punitive, or consequential damages arising from use of the platform or its services — including losses from platform unavailability, third-party content, delivery delays, or product disputes.
Users agree to indemnify and hold harmless Josh Fuels, its subsidiaries, affiliates, officers, directors, and employees from any claims, losses, damages, liabilities, costs, or expenses (including attorney's fees) arising from platform use, obligation breaches, third-party right violations, or user negligence or misconduct. These obligations survive relationship termination with Josh Fuels.
Josh Fuels bears no liability for events directly or indirectly caused by acts of God, wars, terrorism, government actions, civil unrest, or other events beyond its reasonable control.
Disputes between end customers, dealers, or their representatives and Josh Fuels are first attempted to be resolved through mutual discussion. Failing mutual resolution, disputes are referred to arbitration conducted by a sole arbitrator appointed by Josh Fuels at its sole discretion. The venue, place, and seat of arbitration shall be New Delhi. The arbitrator's decision shall be final and binding on all parties.
These terms are governed by and construed under Indian law. Josh Fuels-appointed arbitrators in New Delhi have exclusive jurisdiction over disputes concerning these terms.
If any provision of these terms is found to be unlawful, void, or unenforceable, it shall be deemed severable from the remaining terms, which shall remain valid and enforceable. Non-enforcement of any right shall not constitute a waiver of that right.
